1. Due to the Federal Lawyers' Act (BRAO), lawyers are obliged to maintain professional liability insurance with a minimum sum insured of € 250,000. The details result from Section 51 BRAO.

With regard to the spatial scope, the following applies:

The insurance cover does not relate to liability claims from activities:

a) via law firms or offices established or maintained in other countries

b) in connection with advice on and dealing with non-European law

c) performed by the lawyer before non-European courts

2. The billing of the activity takes place in principle according to the lawyer remuneration law (RVG). As far as different billing is to be done, fee agreements (Section 34 RVG) and remuneration agreements (Section 3 a ff. RVG) are negotiated with the client before taking over the mandate and put down in text in writing.

3. It is pointed out that in the event of disputes between lawyers and the client, in order to avoid a legal dispute, there is the possibility of out-of-court settlement upon request.

The perception of conflicting interests is forbidden for lawyers due to professional regulations (Section 43a Paragraph 4 BRAO), notaries are not allowed to act in a matter in which they or one of their associated lawyers was or is already active (Section 3 Paragraph 1 No. 7 BeurkG). Before accepting a mandate, it is therefore always checked whether there is a legal conflict of interest or a notarial prior involvement.
